Crash Data Ltd – Terms and Conditions

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE. All users of this site agree that access to and use of this site are subject to the following terms and conditions and applicable UK law. If you do not agree to these terms and conditions, please do not use this site.

1. Our Service
   Crash Data Ltd provides specialist electronic repair services, including diagnostic assessment, fault clearing, and crash data reset. Our services are technical in nature and often involve non-reversible work. By submitting an item to us, you agree to these terms.

2. No-Fault Found / Non-Repairable Items
   If an item is found to have no fault or is non-repairable after diagnostics:

• A handling and diagnostic fee will apply.

• Return shipping will be charged.

• No refund is due for labour already undertaken.
  We make no guarantee of success for every repair job and will contact you before proceeding if the issue is complex or irreparable.

3. Customer Error / Incorrect Submission
   If an item is submitted with the wrong fault description, or the item is not compatible with our service:

• We reserve the right to return it unrepaired.

• A service fee and postage cost will still apply.

• No refund will be given for time spent on diagnosis or attempted repair.

4. Warranty and Liability
   We warrant that all services will be carried out with reasonable care and skill. Warranty applies only to the specific fault originally reported and repaired.

Warranty does not cover:

• Damage caused after return (e.g. incorrect installation, short circuits).

• Tampering by third parties.

• Different or new faults unrelated to the original service.

Warranty duration is 90 days unless otherwise stated.

Our liability is strictly limited to the value of the service paid. We are not liable for:

• Consequential loss (e.g. vehicle downtime, loss of earnings).

• Costs incurred by third-party fitting or removal.

• Damage or loss during transit (unless caused by our negligence and the courier is tracked/insured).

5. Return Policy (Services)
   Under the Consumer Contracts Regulations 2013, you may cancel an online order within 14 days only if:

• Work has not yet started.

• You have not expressly requested immediate service.

Once we begin working on your item (as often required urgently), your right to cancel is waived.

6. Refunds
   Refunds may be offered in the following situations:

• We were unable to perform the agreed service.

• The customer cancels prior to any work starting.

• A replacement unit is agreed due to service failure (at our discretion).

Refunds are not available:

• After successful service has been delivered.

• For incompatibility due to customer error or incorrect module data.

• For delays due to courier or customer communication lapses.

Refunds are processed to the original payment method within 14 days of approval.

7. Items Left Unclaimed
   If an item is left with us and no communication or payment is received within 60 days, we reserve the right to:

• Dispose of the item.

• Use it for training or parts.

• Charge for storage beyond 30 days (at £1/day).

8. Customer Responsibilities

• You must package items securely for transit. We are not responsible for items damaged en route to us.

• Ensure you provide correct contact information, order number, and fault description.

• Ensure items are removed from vehicles by competent professionals.

• Orders sent without an order number or pre-payment will incur a £5 administrative processing fee.

9. Testing Fees
   Where a unit is tested and found to be functioning correctly or the reported fault is not present:

• A minimum bench testing fee of £20 plus return postage will apply.

• This covers the engineering time and diagnostic equipment used.

• This fee is non-refundable.

10. Same-Day Repair Services
    Same‑day repair services are offered solely for modules received by CrashData Ltd no later than 10:30 AM on business days. To qualify for this service, each module must be accompanied by a valid order or job number generated through the crashdata.co.uk online booking system, and the repair must be fully prepaid. While Crash Data Ltd will use reasonable efforts to complete same‑day repairs, this service is not guaranteed and is subject to operational capacity. Crash Data Ltd accepts no liability for any loss, cost, or damage arising from delays caused by late delivery, incomplete documentation, non‑payment, or other circumstances beyond Crash Data Ltd’s reasonable control.

11. Order Processing
    All orders must include an order number from the online checkout and be prepaid unless otherwise agreed in advance. Orders received without an order number or without pre-payment will incur a £7+VAT administrative processing fee to cover the additional handling and processing time. Modules left unpaid or uncollected for longer than 60 days will be considered abandoned and disposed of without liability.

12. Copyright and Trademarks
    The entire content included in this site, including but not limited to text, graphics, code and logos, is the property of Crash Data Ltd and protected by UK copyright law. Trademarks, service marks, and trade names of Crash Data Ltd used on the site are registered or unregistered marks of Crash Data Ltd.

13. Disclaimer
    This site and its content are provided “as is” without warranties of any kind, either express or implied. Crash Data Ltd disclaims all warranties to the fullest extent permissible under UK law, including implied warranties of merchantability and fitness for a particular purpose. Crash Data Ltd does not warrant that the functions or content on this site will be error-free or uninterrupted.

14. Limitation of Liability
    Crash Data Ltd shall not be liable for any special, indirect, or consequential damages arising out of the use of, or inability to use, the materials on this site or services, even if Crash Data Ltd has been advised of the possibility of such damages. Nothing in these terms limits our liability for death or personal injury caused by our negligence or fraud.

15. Participation Disclaimer
    Crash Data Ltd is not responsible for user-submitted content on the site and reserves the right to remove or block any material that is inappropriate, offensive, or violates third-party rights.

16. Indemnification
    You agree to indemnify and hold harmless Crash Data Ltd, its directors, officers, employees, and agents from any claims or liabilities arising from your use of the site or breach of these terms.

17. Third-Party Links
    Our website may contain links to third-party websites for your convenience. Crash Data Ltd is not responsible for the content, terms, or privacy policies of these external sites.

18. Governing Law
    These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
